All petitions against company dismissed; Back to business, with lessons learned LONDON, May 14
LONDON, May 14 /PRNewswire/ -- A British court has dismissed all government claims against Amway (UK) Ltd., ending a lengthy dispute with a solid validation of the company's reformed business model.
The ruling by Mr. Justice Norris of the High Court declared that the company could continue doing business under a series of reforms volunteered by the company over the past year.
The judge did express his belief that Amway allowed "misrepresentations" of its business by Independent sales organizations in years past, and failed to act decisively against those misrepresentations.
However, he then noted that he was satisfied that the "radical changes" introduced by the company in the past year remedied earlier faults. The reformed Amway business model, he wrote, is "fully formulated, comprehensive, open and transparent and capable of effective and ongoing implementation without supervision."
The company said in response: "We are gratified the judge understood our commitment to reform and protecting consumers.
"We are also gratified that the direct selling business model received validation from the court -- as courts and regulators around the world have done for nearly 50 years.
"Even so, we take seriously his view of our earlier business model. We will work tirelessly to make certain we do not find ourselves in this position again.
"We are proud of the more than 100 UK-based Amway employees and more than 10,000 distributors there who have stood by us during this difficult time. We look forward to getting back to work, helping distributors earn additional income through the sale of quality products."

Latest news....As my very first email quoted. i truly believe this to be war on the system lords. I really believe Amway Quixtar are resolute in finishing the expensive systems.

Dear Demetrius,

Please find attached a note from the desk of Jim Payne, Executive Vice President and Managing Director of Quixtar and Amway.

Over the past three weeks, many of you have raised questions regarding the allegations made by the DTI (Department of Trade & Industry), which have led to subesequent changes and actions by Amway UK. It's a time of change for Amway UK. The measures that we have put in place were our first response to the DTI. The note from Jim outlines the most recent developments with regards to our on-going dialogue with the DTI and I would urge you to read this carefully.

There are a number of rumours circulating as a result of the court hearing on 21st May. It's our intention to share information with you when we can and to be as open and transparent as we can be. We are giving you the facts here.

Over the next few day's you will be receiving communication from my team with regard to training which was also referenced in my letter of 4 May. We have a great team of people here who are willing to help you with any queries that you have. Please pick up the phone and speak to us if you have any concerns.

Your support and committment to the Amway Business is noticed now more that ever. We have faced many challenges over the years in a number of markets, which, with our IBO's, we have overcome and worked through, just as we will now in the UK with your support.

Jim Paynes' note to you today demonstrates that our senior executives world-wide are 100 % committed to the future of the Amway UK/RoI business and we will emerge from this as a stronger business with an even stronger opportunity.

With my very best regards,

Ben Woodward
Branch Manager - UK and RoI

24 May 2007

A note from the desk of Jim Payne

Executive Vice President & Managing Director of Quixtar & Amway

We would like to update you on events in the United Kingdom, where Amway,
Network 21 and Britt World Wide are involved in a legal dispute with the UK’s
Department of Trade and Industry.

What’s happening

Following an investigation that lasted more than a year, DTI last month issued
individual petitions against each of the three companies, claiming each was
engaged in "objectionable" practices.

The DTI’s petitions initiated civil court proceedings, which, if successful, could
lead to the closing of each company’s business operations in the UK.

We are obviously disappointed that the DTI felt the need to take us to court. We
certainly do not agree with all their claims.

But most important, we intend to address the problems that may exist in the UK
and around the world so that no government ever sees the need to step in again.

What it means

The heart of the DTI's position, as we understand it, is that the business
opportunity is promoted by incorporated and unincorporated organizations in a
manner that does not reflect the financial rewards people are likely to earn when
they participate in the Amway business.

The DTI also objects to the manner and frequency in which meetings and BSMs
are promoted by the sales organizations in conjunction with the Amway business
opportunity.

Amway’s fault, according to the petition, lies in our failure to take sufficient action
to prevent these abuses from occurring.

Following a first court hearing on May 21, 2007, the DTI's case is now scheduled
to be heard by the Court later this year.

At that hearing, the Court ordered DTI to set out its case in more detail so that
Amway, Network 21 and Britt know precisely what is being alleged. Each
company will have the opportunity to respond to the claims and to submit
evidence.

What’s ahead

Though the trial is still months away, Amway has already offered important
"undertakings" to the Court, which we believe address the DTI’s principal

concerns. These undertakings make it clear that Amway will stand accountable
for the experiences people have when they join the Amway business.

In shortened form, they are:

• Prohibiting business support materials that are not authorized and
distributed by Amway.
• Prohibiting meetings where an entry fee is charged, unless Amway has
approved the meeting and its content.
• Imposing a moratorium on the registration of new IBOs for 120 days, then
introducing a revised registration policy.
• Providing the DTI 21 days’ notice before restarting the registration of
IBOs.
• Amway will not implement any policy that requires payment of a
registration fee prior to the hearing of the petition.
• Amway has also volunteered to inform the DTI of any violations of the
corrective measures, and the action that Amway will take in response to
the violations.
Once the business review in the UK has been completed and a new mode of
operation has been devised, we will inform the DTI of the details. If the DTI is
satisfied that their concerns have been addressed, then Amway will invite the DTI
to end its legal action. If the DTI is not willing to agree to this, then the matter will
be decided by the Court.

One further note. We have already weighed in against "spin" from tool
companies. We have read the complaints. These problems are not Amway’s
alone. Comments that suggest otherwise are wrong, plain and simple.

Conclusions

We fully intend to provide business reforms in the UK and in any other market
where we see that business practices can be improved. A promised global
review of practices is underway, and we are on track to release its findings next
month.

We are holding ourselves accountable to deliver on what we promise.

We expect all our business partners to deliver as well.

There have been enough of these disappointments. They are serious distractions
to the operations of the company, embarrassments to the many IBOs and
Amway markets that provide exemplary service to the public, and a threat to the
company’s long-term health.

Change is on the way.

UK blow up latest from www.mlmleads.eu !!!!

-----Original Message-----
From: a@btinternet.com]
Sent: 15 May 2007 13:25
To: Demetriuseto@yahoo.com

comment from webmaster. This email shows quite clearly and insight into the internal working of a network, it is interesting to expereince the desperation of a hard working ibo, to get his so called mentors to listen, it is really a cry for help and shows how genuine people are about there Amway businesses. his reward for this email was to be banned.

Dear Demetrius,

I was present at the meeting with our awesome US upline and there was no talk of any one been banned. In fact the meeting talked about how unified we were.

Since then I realise I was mislead.

I have found out since the ibo who sent this email, was in fact told he was not welcome at the meeting. The reason because he sent it crossline. Well if this was the reason, no one should have been at the meeting!

Yes the email is slightly over the top but knowing the ibo, who is eccentric to say the least and very funny, this should have been taken into consideration.

I agree with his points, its a shame they were not allowed to voice them. I am extremely disapointed. I will email the ibo today to let him know I have posted his email.

Hopefully they wont be upset. I have taken their names and my name of, I hope you undestand this.

Subject: Re: plat meeting sat Al b etc,

I gather the DTI complaints don’t involve the BWW team, however as we have a 8 week sabbatical and the meeting on Saturday will it gives us the opportunity to sort out our own act.

You probably heard the expression "pig don’t know pigs stink" and based on my last tools meeting, recent events and the attitude of some of you, to your upline and britt office here in the UK. It is a remarkable opportunity to see if we can all get on the same unified UK page. I would also say the lack of our needs by the US Britt office and based on my last tools meeting, is totally arrogant to the UK needs and strikes me that we are never going to be listened to, unless we have a massive business and BWW have something to loose.

Before I start, how many of you have phoned the Britt office to offer your support to S and to Pe and Lo
I would point if the DTI come hunting it will be the Britt office staff and P and L who will carry the proverbial can, your US upline wont!. God Bless them they are under extreme pressure, and your encouraging words would help. They deserve a bit more tlc, than some of you have shown.

I occasionally get emails from some of you crossline with something like, "we are the most unified team in the world blah! Blah! Blah!"

Well blah blah blah why don’t you show it, to your UK leadership.

Actions recently have further highlighted your lack of edification and unity here. I will list a few, just in the last couple of months.

Attitude booked for 19th 20th May

At the time I said how dare an ibo, who left BWW and came back, send me an unsolicited email for a function booked with it not been sanctioned by BWW and not only this at £12 a time and only 5 days after a major. Stupid stupid and more stupid. I knew BWW would not sanction it……wrong!!!!! More stupid stupid decisions it was sanctioned, and for only one reason more money in the system. In retrospect this has left us wide open with the DTI investigation into to many functions and once again we are left to pick up the peaces in the UK.

If we are allowed functions again this type of maverick organising has to stop. Your uplines or mentors in the US have to stop interfering in the UK domestic business without informing and councelling with the UK leadership and Britt office.

Silver weekend.

I fully understand some of you made it clear because of weddings etc. that silver weekend was out. However many of you indicated you were going, bookings were made and then on mass you cancelled, with what I can only describe as puny excuses. Some even said they were going to functions in the states! Unbelievable de-edification, of the home leadership team. What are your mentors teaching you….other than non unity in the UK.

In other words you deedified a home function for international functions. Although cancelled now anyway, this weekend would have been very important in the unity and comradeship of the Uk leadership.

Once again a great opportunity lost.

I wander how they would react in the states if I was counselling my people in the states not to attend particular function. That’s right, I think there would be something said, don’t you.

Open meeting

I gather a group split away from a London open, once again without counselling with their uk Team leaders. What ever reason you done it for, remember THE TEAM is far more important than your team. If your US upline advised you to do this, once again it is illegal interference in the UK business. And did they get both sides of the story and check things with their UK upline leadership emeralds? If not shame on you and them. Luckily the open was big enough to keep on going. I have seen similar things done in our past Amway life and eventually it has destroyed both meetings.

System money

There is more secrecy over system money than there is in the Masonic industry. It leads to mis trust and worse still accusations of mis handling of funds, and eventually fraud, which the DTI are pursuing now. In light of the fact that we still not have a British infrastructure in place after all these years, in the DTI s eyes, it could lead to us been investigated for mis handling of funds. Do we want this cloud to continue to hang over us? We need to be open about where the money goes….now.

S and I didn’t even know there was a break on tools until we hit platinum; these days with the various negative sites it is common knowledge. If we are not to be up front, with the accounts available for anyone to look at, we are on a very sticky wicket. I hope our strange secretive system changes. People now are starting to build the business and get people systemised for the wrong reasons.

Some of you know my feeling concerning the infrastructure of the UK business, I stated it quite clearly at our first meeting in Milton Keynes. It was never heeded and now we once again find ourselves with nothing to relate to the real UK population. Ie. The British.

This is not to de-edify my foreign brothers, you know I love ya, but I want to build a business here in the UK with the Brits. After all it is the much larger part of the population, it makes business sense, 55 million. As of before Amways email we had nothing and now we have the same….nothing. So I suppose at the moment there aint much about the system im missing, other than the company of you lot..

We need freedom to make choices at bsm meeting, not dictatorship. We need to be able to choose our own books, which relate in this country (see Helens letter below). We need British speakers and cds. If we can have a motivational speaker from the US over here, who might have won a water treatment competition for Amway, but never really built the Amway business, why not British Motivational speakers? Why not, the numerous crossline emerald and diamond UK speakers….i could go on but wont. But I hope you get my point.

Im sure if the BWW big shots would step of their high horse and wonder how they would react, if they only had UK cds and books in their system after 25 years,, and mainly only UK speakers. They might have a bit more empathy with my forthright but right advice. You know walk in someone elses shoes.

….system money, has become a swear word in our industry, other than the very few who make a lot. I think system money has led to our Britt team splitting at 4 times now. It has always been the Achilles' heel of the business and even now, it continues to bite us in the bum.

in the UK system at the moment 95% of the cds are US
95% of the books are US
95% of the speakers are US

when are we going to cotton on for goodness sake!

All we are doing is feeding their pockets!

There are inherent challenges on the horizon with BWW and our UK system and if they are not address, then I can see an ultimate break up of our own system (if it is allowed to go on, in its present format) and eventual closure by the DTI. Tell that to your US upline, the next time they encourage you to do an unauthorised meeting, and they take the money..

Im sure on Saturday A will reassure us the B has been to Ada. And everthing is gonna be great. I believe that and hope we can all go away sat unified under the same cause. As ever, if I have upset you let your UK upline or UK mentor know…that will be a good start. If you support what I say, in the past I have had just about zero support, judging what A B has said to me, you make sure you have the guts to express your opinion, perhaps then they will listen and we wont have to again have to put up with the mess we are experiencing at the moment..

H email

Hi Upline !
The forthcoming tools committee meeting has prompted me to express
a concern and forward a suggestion.
I feel that some of the books we receive on the book of the month
programme are not the best we could invest in in the UK market. Many
seem to me to be taking advantage of networking organisations
Guaranteeing large sales of their book.

Some seem to be re-hashes of
existing PMA ideas by slick salespeople. I do not particularly wish to
encourage such authors by giving them my money (in the same way that I
rarely buy newspapers) , when there are so many more beneficial options.
I have the following suggestions...

1) Could we include 'classic books' ? I can see far more value in such
authors as Waitley, Carnegie, Schuller, Covey, Mandino etc. What about
Personality Plus, Skill With People, The Five Love Languages ? I would
much prefer a duplicate of a great book than another inferior one.

2) Books of substance recommend that we read autobiographical material
about successful people. Can we learn from the likes of Churchill, trump,
Mandela, Branson, Sugar, Robinson, Lincoln, Radcliffe ? (I seem to have
included some British names. After all , this is Britt UK , not Britt USA !)

Of course there is always room for an excellent new book eg Copycat
Marketing, Beyond The Summit, or more from the British PMA writer Robin
Sieger. But I do feel that we could improve the overall quality of the
book education we put out to the organisation.

Thanks for listening !!
H

Hear hear

Viva la revolution and God Save the Queen.

Love ya

Please note this communication has been sent in the following order to all Diamonds, Emeralds and Platinums.

Dear Leader

During this week we are changing our AMIVO website, as part of the plan to offer our Independent Business Owners and Members even more reason to buy our great Amway products online.

We will be taking the opportunity to accelerate our programme to move towards ‘Amway’ branding for our e-commerce websites, in line with existing European strategy. ‘Amway’ branding of websites has already been successfully achieved in 11 European countries, and will ultimately roll-out to all European markets.

In the meantime, when visiting www.amivo.co.uk you will be displayed a holding page, informing you about these changes to the Amivo website. On this page, you will be able to click on the link to be redirected to the Amway UK website (www.Amway.co.uk)- where you will be able to log-in to Amivo and find all of the support you have been enjoying as normal.

In coming weeks, we look forward to sharing our new plans for our websites, and what will be offered to all who want access to our fantastic product range and business opportunity.

Yours Sincerely

comment from webmaster.
