Efusjon and Derek Broes Lawsuit?
Posted on 20. Sep, 2009 by Ty Tribble in Efusjon
I just unleashed 7 of my most closely guarded Internet Marketing files for the first time. Download Ty Tribble's MLM Web Secrets. It's my free gift to you for visiting.
Would you trust anything said by Efusjon at this point? What a disaster.
Here is a recent communication from Efusjon President, Robert Towles:
If you enjoyed this post, make sure you subscribe to my RSS feed!I am writing to all of you in relation to the unusual and disruptive events that have occurred over the past few days. The announcements, calls and electronic statements issued by Derek Broes were in no way representative or authorized by myself or any officials of the company. Derek is not an officer of the company nor privy to or sanctioned to speak on behalf of the company as a whole.
We apologize that over the past few months we haven’t been able to be more forthcoming with information. We know that it was somewhat confusing and frustrating, but please know that, for legal reasons, we are unable to communicate more directly.
However, in light of recent events we all agreed that it was important to inform you of the situation at hand to avoid any potential misunderstandings due to propaganda and statements being made. Additionally, in past notices to the field we have done our best to emphasize that we are the number one and only source for accurate information about the company and are readily available to provide answers as best as we can. We built this company on an open and honest business model and have no plans to deviate from that course.
Additionally, we want to address one other issue that has been raised on numerous occasions in reference to publicity. We want you to know that we have a seasoned PR group fully-engaged to conduct all outreach to the media in reference to efusjon. Unfortunately, the PR aspect was also interrupted and limited due to legal disclosure matters and we had to be very careful in what we did on that front. However, we have been working tediously to identify ways to work around it and have numerous programs currently in effect that will begin to draw media attention and raise awareness. Being sensitive to the field’s need for exposure to help sell product, they ask that if there are certain markets, publications or outlets that you want special attention paid to, that you email them to press@efusjon.com and they will reach out to them ASAP. All of us want and are looking forward to coverage of the company and products as we know that it will do a lot to help you sell product. We are expecting some media coverage to hit very soon as we have been conducting interviews about the company and have product in the hands of many elite journalists, television shows and more.We want to reiterate that we work tirelessly to ensure that all facets of the company are operating at peak performance to ensure that the field can simply focus on what they came to the efusjon Energy Club for - to help build a great business with a great product.
We truly appreciate your membership and support and hope that we can alleviate any concerns you may have had.

Can I trust anything YOU say at this point? Just by making that comment it shows you have a real bias against Efusjon. I really liked coming to this blog because I found you to be impartial, just reporting the news in the MLM world. However I found that letter from Rob Towles to be much more professional and forthright than what Derek Broes has been doing lately. Sure the comp plan was changed and that stinks. Sure the Facebook App wasn’t the magic ticket to millions of dollars. But until this is all settled, how do you know that it isn’t Derek’s fault everything went to crap and Efusjon is in the right? Please hold off judgment until all the facts are out. There are always two sides to every story and the truth usually lies somewhere in the middle…

Let’s see…two compensation plan changes since April, a joke of a Facebook application and Robert Towles started telling the truth about Efusjon after we exposed them here at the MLM Blog.
I think it’s fair to question what is being said now.

The only reason I got into Efusjon was because of the hype associated with the Facebook application, because I knew that Derek was a smart guy. I knew of Derek before I was involved, and his participation encouraged me to get myself and others involved almost in spite of the product, which I felt was unimpressive, late in coming relative to the push and ungodly expensive, even for shipping.
But when I found that I couldn’t even send an Facebook message with the mention of “Efusjon” in it or a link with the name in it, I asked the people at Efusjon: how do you expect a Facebook application to work if you can’t even mention the name without getting a notice that it’s been cited as objectionable by Facebook members, and could get you booted off the site?
Honestly, I’ve got a stack of product that I will eventually use. But how anyone thought that an energy drink that tastes like Grape Nehi soda was going to compete in the energy drink market is beyond me. I got into it because of the potential of cracking the Facebook/Social Media barrier to marketing, not because of the “me, too!” product..
My questions to upline and to corporate about Derek and the bus, about the many delays of the launch, about why my commissions went DOWN after the launch have gone unanswered.
With the company having failed miserably to deliver on the Facebook promise, I’m dropping Efusjon, and have already told my small downline that they’re free to go, with my apologies for getting them into a scam.
That corporate chose to characterize what were firm assurances – that the FB app would forcefeed the matrix, and make successes of anyone who had their three – as “urban myths” indicates to me the total lack of authenticity of the company and its founders and management.
Ty, above, has addressed the changes of the compensation plan and the mechanics of the company.
In this case, I don’t feel the truth is in the middle. I think Ty has hit it on the head.

Ty is right…
As a well known industry leader (in 2 opportunities prior to our current company my partner and I had combined teams of over 600,000 distributors and group sales of $2 billion, coaching numerous people to incomes of up to $1 million a year and more), I’m amazed at the number of people blindly jumping on the Efusjon bandwagon who are obviously new or not very experienced or knowledgeable about our industry, especially pay plans, and Efusjon is a perfect example!
The recent changes at Efusjon (several pay plan changes already) plus the fallout over the less than stellar performance of the much hyped “Facebook application” has caused numerous people to leave Efusjon. Here’s why:
1) Efusjon is less than 2 years old. 98% of new companies fail in their first 2 years! Furthermore, of the 30,000-50,000 companies that have launched in the past 6 decades, less than 100 have made it to the 10 year mark! You’re talking 1 company, on average, out of every 300-500 companies that launch surviving 5-10 years! One! That’s called luck! A fluke! No smart entrepreneur bets their success on luck! If you were looking to put the odds of success in your favor, you certainly wouldn’t choose a new, start up deal!
Of course, the “big lie” that is used to promote groundfloor programs is that it is those that are in at the beginning are the ones who make the big money, and that is the rationale for taking a high risk bet. There’s just one problem: It’s just not true! Most top income earners at the “old school” companies are not those that were in at the beginning. Many didn’t get involved until the 2-3-4-5th year or later!
2) Matrix plans do NOT work which explains the frequent changes at Efusjon! Of the 30,000-50,000 opportunities that have launched over the past 6 decades, only 1 has experienced any significant, long term success with a matrix pay plan-one, and that company has had to modify their plan on numerous occasions in order to keep their top leaders! Whenever something only works once, we call that a fluke!
Nobody in their right mind would get involved with something that has only worked once! (Owners looking for a short term cash grab like them because they know that their company is not likely to be around 2-3 years from now and matrix plans pay out less money than any other pay plan due to all the breakage that occurs, regardless of whether it’s a forced matrix, has compression, etc.)
Furthermore, the one particular company that has had some success with a matrix plan launched 25 years ago, when there were far fewer opportunities available. Today that same company probably wouldn’t survive 10 years. In addition, they’ve had to make numerous changes to their plan in order to retain their leaders, many who left anyway.
In fact, there’s hasn’t been one company in the past 10-15 years with a matrix pay plan that has generated substantial numbers, experienced long term success, and generated a large number of high 5 or 6 figure monthly incomes-not one!
No experienced or knowledgeable network marketing professional with an understanding of the history of our industry and compensation plans would ever work a matrix plan, no matter what typical wrinkle you add such as forced matrix, compression, or some other new fangled idea as they are notorious for breakage and pay out far less than other pay plans, which is one reason for the several pay plan changes made already by Efusjon!
Claims of massive amounts of potential spillover are further evidence that people have no grasp of how compensation plans works. Each level you go down in a matrix plan the less in potential spillover occurs, not more! It’s a basic mathematical fact! (If you want maximum potential for spillover, work a binary plan!)
Additionally, regulators consider matrix pay plans gimmicky and they’re most often associated with “money games.”
So far, Efusjon has made several changes in their compensation plan and I’ve got news for you-they’ll be making several more, it’s just a matter of time! Why? Because matrix plans don’t work!
Reasons #1 and #2 would be reason enough not to get involved with Efjusjon IF you were looking to put the odds of success in your favor! You’ve got the biggest strikes against right from the start! The odds of a new company surviving 5 years are 1 in 30-500 (talk about a long shot!) and a pay plan concept that has never worked! Nothing like virtually guaranteeing you’re going to fail than signing up in a new company with a matrix pay plan!
And then people wonder why 97% of people in our industry fail, never succeed, and never make money! It starts with making a smart business decision and putting the odds of success in your favor, not trying to beat the odds!
As if reasons #1 and #2 weren’t bad enough…..
3) The “Facebook application” has been one big hype job! In fact, Facebook itself is not real happy! Furthermore, driving traffic and attracting eyeballs is one thing-whether or not they stick once they sign up for the long term is another matter, and in fact, due to having a matrix plan, that virtually assures they won’t stick long term.
Many are already leaving! (If they knew points #1 and 2 above, they never would have gotten involved in the first place! You should always to try to put the odds of success in your favor, not try to defy history and the odds, which is usually a recipe for failure!
In addition, anyone can create an application for Facebook, just like you can for eBay.
Here’s 9 additional reasons why Efusjon people are moving to VEMMA and it’s Verve energy drink, which is a much smarter business decision:
4) VEMMA’s Verve Energy Drink is a Superior Product!
Verve has a higher ORAC score and a complete spectrum of 12 vitamins, 65 essential and trace minerals, antioxidants, Aloe Vera, Green Tea, and the amazing superfruit, Mangosteen, is supported by clinical studies, and recommended by leading doctors! In addition, Mangosteen is considered to be a superior superfruit to Acai as shown in Men’s Health magazine. Efusjon is NOT a full spectrum formula and has no clinical studies!
Verve is available in 8 ounce cans and 3 ounce shots with regular or sugar free versions.
Most exciting, we have recently launched an exciting product for children 2-12 years of age!
Finally, VEMMA has its own 70,000 square foot, state of the art manufacturing facility.
5) VEMMA Has Superior Value!
In VEMMA, the distributorship is FREE! Efusjon charges $30!
6) VEMMA Has Superior Recognition and Media Coverage!
Verve has just been named 2009 Product of the Year in competition held by a leading fitness/health publication whose judging panel included fitness pros, doctors, and anti-aging specialist and it’s now the official energy drink of 4 U.S. pro sports teams, a first in network marketing history!
In addition, it’s been featured on the covers of and/or in such magazines as Success, Women’s Fitness, Work at Home, Ms. Fitness, and others!
7) VEMMA Has a Superior Pay Plan!
Top distributors are earning up to $100,000 a month and more within 1-3 years, most having started part time and the best part is you only have to build 2 teams! Top incomes after 3-4 years are up to $2 million a year and growing! And the best part is in VEMMA’s distributorship is FREE (Efusjon charges $30) and in VEMMA you get paid weekly whereas in Efusjon you don’t get paid until the middle of the following month!
VEMMA is a rapidly growing, 5 year old international company recently featured on the covers of Success magazine and Direct Selling News, one of the industry’s leading trade journals! The VEMMA ownership and management team has already built one billion dollar network marketing company (the parent company of VEMMA). Who is more likely to build a billion dollar network marketing company-People who have done it before or those that never have done it? Common sense should give you the answer!
9) VEMMA Has More Countries to Market In!
VEMMA is legally operating in 50 countries, far more than Efusjon, with an emphasis on legally! Most MLM companies “fly under the radar” when it comes to operating in foreign countries.
10) We Have a Superior Team to Join!
My partner and I have 60 years of combined experience in network marketing, having built some of the largest, fastest growing and most successful groups in the history of the industry. In 2 companies prior to VEMMA, we built combined teams of more than 600,000 distributors, generated $2 billion in group sales, and helped numerous people on our teams to earn up to $1 million a year and more!
We’re now #3 top earners with the number one international group! Join a team with support, training, a powerful, online business building system, and leadership! You’ll be sponsored by and work directly with us!
11) Timing and Positioning
Here’s the best part! Once you’re positioned on our global expansion team, everyone we sponsor in any of 50 countries goes below you, positioning you with the opportunity to earn an income on their sales and on the 2 teams they develop, enabling you to primarily focus on building just one team! It sure beats having to build 3 “legs” or teams!
12) State of the art, web enabled websites with facebook and twitter application, blogging capabilities, and more plus advanced back office architecture with up to the minute details on your business.
13) VEMMA has a stronger story!
We invite you to take a FREE tour of our powerful, automated, online business building system, the industry’s most successful over the past 5 years. Who knows…while you’re on the tour, you might end up with a few potential distributors being placed below you, and if you decide to upgrade by the end of the current cycle, you’ll end up having them permanently below you should they decide to make a smart business decision and become a VEMMA distributor. First of all if you don’t like or believe in the product your selling then you shouldn’t have gotten involved in the first place! Second you can send out information about Efusjon on facebook. You can not send out a website address and put the dots for .com. Just put the website and leave out the dots. Now if you thought facebook is going to be the only way that you were going to make it then you probably wouldn’t have make it anyway. Facebook is just another Tool to help build your business. Even with facebook you have to get involved by commenting on everyone’s pictures and communicating with your entire network of friends all the time. If you just out of the blue send someone a link to a game or tell them about something to do with network marketing they will think your crazy and wonder why all the sudden you are trying to contact them when you have never done so before. Now I am sorry that you misunderstood what could happen but you took a RISK and that’s all you did so don’t say it’s a scam because you failed to do your homework on network marketing. If you want to be mad at someone then look at the person you followed to Efusjon, Derek Broes. Rob Towles has said the entire time that facebook is just another tool not the holy grail to success! Now the person that got me to join called me a week before the launch of facebook and told me I should join before the launch and so I did. Well im not mad at him or Efusjon. So why are you mad? It’s a risk you take just like any business. Now if you cant afford to take risks then you shouldn’t take them.

Now for the MLM Expert! You keep copying and pasting the same thing over and over.
If you wanted people to listen to your opinion about the risks of using the matrix system then you should of stopped at that but you kept going to tell them about your company is better then Efusjon. Now when Verve first started you also had a 95% chance of it failing but it took time for it to prove itself. You say you are in other countries and in many magazines but I think you may have forgotten of how long it took you to get there. You also tell only the pros about your company and nothing about the cons. Now I know people that use the binary plan and two of them have been hurt really bad from it. In both cases they lost a left or a right leg due to someone leaving and taking people with them to another company. Now they have to start all over again. One company is Mona-via and the other is Verve.
So you see the irony in all of this is when you bash someone else’s company and then they turn around and do the same to you. The out come is you will always see people jumping from one company to the next like a bunch of frogs with no direction! Whats funny is you claim you’re a professional. You just seem like a snake to me.
For ALL the people going around and bashing other companies it will come back to bite you in the ass! Run your company with the future in mind. Don’t just worry about making money today, think of doing it long term. Try to keep it honest and never let money or greed change you!

Personally I have witnessed a lot of this hype take it’s told on the Efusjon business, but I have also noticed that not one seasoned marketer that I have been in contact with will ever touch Efusjon. In fact, before I joined I was warned my many of these marketers to stay away. I guess that I was too head strong and jumped in anyway “don’t tell me I can’t make it work” situation.
I should have listened, my group fell apart and I understand that the FTC has new items that they will be bringing up. I have also heard that the state of Utah has outlawed this type of matrix and there is a chance that the Utah Efusjon groups could be shut down completely.
I have been able to redeem myself and get reconnected with some very successful marketers in a new business that already has, in less than a month, over 100 years of experience on the top of the matrix. I am now positioned in 3 spots directly below 2 of the company’s key distributors. One of our spots is on the second row of the Master Distributor and the other 2 positions are placed under 3 different seasoned marketers that carry over 25 years of experience each, needless to say, I have been able to set my group up very well!
Good luck to those that try and “Stick it out” with Efusjon… as for me, I will go where all the leaders are.

Scott:
Thanks for jumping to conclusions and calling me a “snake” without knowing me…
Second, copying and pasting the same thing over and over? Not here I haven’t….in other blogs my reply is always the same because the points being addressed are always the same!
Furthermore, sometimes the “teacher” has to repeat things several times before the students get it??? Frankly, most of the people that have joined Efusjon are newbies to the industry and in need of an education on the history of our industry, pay plans, etc..
Second, you must be new to the industry…the reason why VEMMA’s chances for success were much greater when they first launched compared to that of the typical groundfloor start up is that it was being launched as a new division of New Vision, an already pre-existing 10 year old company with over $1 billion in sales. VEMMA had the luxury of already having a proven foundation in place, the same ownership and management team, the same manufacturing plant, the same IT, the same field leadership as obviously a large number of the top earners from New Vision and New Vision distributors had the opportunity to also have a position in VEMMA…the primary differences were that VEMMA was only going to have one product at the time versus 60 in New Vision, and where New Vision was a unilevel plan, VEMMA was a binary…
Regarding your comment that my analysis was fine but people stopped reading once I began to mention VEMMA, you guys that are so into social networking think that just because you happen to mention something company specific that somehow people won’t or don’t read it or that they are suddently going to think you are less credible is just plain wrong! It depends on whether or not the information is presented in a factual matter and documented versus the typical diatribe filled with nothing buy hype that most people resort to…
If you can demonstrate legitimate reasons why one company may be in trouble and why it might be advisable to take a serious look at options, most intelligent people would immediately wonder what companies might be a viable alternative for them…instead of the typical hype that most would respond with, I laid out a series of points based on facts and verifiable information, so if you were wondering what might be a viable option, the points I put forth would be educational and point someone in the right direction based on sound analysis and facts.
Your indictment of the binary plan is hilarious…Someone decides to leave a company and take their group with them and you blame the pay plan? Huh? That happens all the time in our industry, be it a company with a binary plan, a unilevel plan, a stairstep plan, or a matrix plan…In this particular case you had 2 friends where this occurred and they just happened to be in companies with a binary plan. You can’t blame the pay plan for that! That’s like blaming an automobile for being involved in an accident when the person the wheel was intoxicated…you blame the driver, not the car!

His name is Ken Stewart and he’s been caught bashing efusjon and promoting his VEMMA business in numerous efusjon threads on facebook.
He is a VEMMA spammer that bashes efusjon for a marketing tactic for a product that he worships.
He thinks his product is a gift from God, and will do or say anything to make his compensation plan and product look better than his competitors. He has poor online marketing techniques and gets jollies from negative responses to him.
Do not respond to him or you will be going on a wild goose chase to try to convince him that VEMMA isn’t Jesus Christ incarnate.
Peace.

Kirk, you never cease to amaze me!
Caught? LOL…First, the reason why the response of mine is similar in several blogs is because people like you keep saying the same things in these several blogs that are nothing but opinions based on no facts, no documentation, hype, misinformation, and erroneous information, all of which you keep trying to present as either facts or true, when they’re not, so I have to keep correcting the record.
Second, your response is hilarious! You’re actually describing yourself, not me as the one who is oblivous to history, facts, and documentation and thinks they’ve got the greatest product ever created (we’ve already proven there are other several superior energy drinks to Efusjon based on lab tests, ORAC scores, clinical studies, etc.) and we already know that matrix plans have historically never worked, except in the case of Melaleuca, and they were launched back in 1985!
Since then not one company with a matrix plan has achieved any substantial, long term success! Period! Yet you and other minions keep spouting about how great the pay plan is . Talk about delusional and being oblivious to the facts and history! Now that’s worship!
Finally, when my analysis is slanted towards the negative (like this latest shows) can you please skip the flaming of my character and the part about my being biased and my motive being to “bash competitors”?
A teacher in a debate class once told us, “As a last resort, if you can’t diminish the quality and credibility of your opposition’s points, try to diminish the quality and credibility of your opposition”. So please, rather than attacking WHY you think I’m making the points I’ve made and trying to accuse me of worshipping, let’s focus on the ACTUAL POINTS being made.
In fact, let’s assume you’re suspicious are true. I’ve gone over to the dark side, and I’m now just carpet bombing and spamming to make Efusjon look bad and to make Verve look good… You got me. I’m busted. You’re absolutely right. (In agreeing with you, then we take this out of the debate.) Now… please tell me WHAT POINTS and FACTS are inaccurate or not true, which is the real issue that you keep trying to divert attention away from!
The answer is you can’t because I’m the only who knows what they’re talking about and can document the points being made with studies, lab tests, ORAC values, magazine articles, etc., and all you’ve got is an opinion and hype!
Case closed! Anytime you’re running around talking about how great the product is with no documentation and touting how great a matrix pay plan is when history proves it’s exactly the opposite, that is someone who is intoxicated with worship to the point they are oblivious to the facts and reality! Now, that describes you to a “T.”
Finally, as I have mentioned to you in other blogs and having to do it here again, once again proving another point of mine that you guys, like a broken record, keep making the same inaccurate comments or misrepresentations in various blogs which necessitates the same response on my part, We have organizations in several companies so this whole notion you keep trying to perpetuate that I’m some zealot and bleed VEMMA blood is laughable..

I say forget efusjon and invest your hard earned money into something that truly affords you the benefits of leverage, without living on a hope and a prayer. That is just my humble opinion.
efusjon is currently facing a massive class action lawsuit and whether they win or lose, the ultimate losers will be the distributors who have to explain why their opportunity is being taken to court as an alleged ponzi scheme.
I personally enjoy a product that has an undeniable value as well as the potential for huge returns. As for Vemma…hey if it mixes well with Vodka, Gin, and Rum – I’ll drink it!
Great discussion guys…keep civil and respectful!

“MLM Expert” uses the same text and cuts and pastes it on every blog he can find about Efusjon. He also goes by “MLM Dream Team” His real name is Ken Steward. It is nothing more than a tactic to get people into his other opportunity. If you don’t believe me just take a paragraph from his original post here and paste it in Google search. You’ll see all the pages where he has used this to try and recruit people to his other business. Don’t believe a word he says… he has motives. He is also a defiant spammer and will defend his cause to no end…pathetic.
Efusjon is moving forward and is in a better position now because of the great comp plan changes/additions. They wanted to get the compensation plan right moving into international launch and that is where we are right now. For those that stick with it and use a proven system to build their business, they are in for the ride of their lives.
