Freelife's Dr. Mendell made a bunch of claims about Goji Juice and ended up with his foot in his mouth.
Quixtar's executives would probably look equally as foolish answering direct questions about the system tools business.

The rest of the BioPerformance, Inc. story
Media attention to the announced settlement by the Texas Attorney
General in State of Texas vs. BioPerformance, Inc. has unfairly relied
exclusively on statements in the AG's press release and video announcement.
The settlement was a two-sided agreement between the State of Texas and
BioPerformance, yet news sources have not attempted to report on
BioPerformance's position - in spite of its simultaneous press release that
was circulated nationally. See attached.
The news fact that should catch your attention-and something that
was provided to the AG during the negotiations, is that only BioPerformance
tested the product in vehicles, and only BioPerformance has independent,
scientific proof about the product's effectiveness. See attached. In spite
of false and reckless statements by the AG that the product is worthless and
is a "do-nothing" pill, the AG never tested the product in vehicles. The
bottom line is that actual testing, per rigid protocols for the FTP and HFET
tests under the EPA's "Motor Vehicle Aftermarket Retrofit Device Evaluation
Program", was performed by an independent laboratory, and those tests
demonstrate "real improvement in reducing emissions and fuel savings" based
on EPA criteria.
In addition, the AG did not "shut the business down." In fact, the
agreement reached with the Attorney General and signed by the Court
expressly authorizes BioPerformance, Inc. to continue marketing its proven
product. Further, BioPerformance, Inc. argued with the AG for the right to
use the funds on hand to make refunds to any of its customers who wanted
one, regardless of the reason, but the AG insisted on having his name on the
refund checks.
Out of a simple, but fundamental, sense of fairness, is it too much
to ask the free press to provide both sides to this 2-sided settlement
agreement?

A city councilwoman in the UK was caught reading an Avon catalogue during a council meeting...

minutes reading the catalogue and making up an order form of items.
"I
cannot believe that someone could blatantly sit there through a council
meeting ordering her next colour of nail varnish from a catalogue!"
Coun
Benson, who represents Greenlands ward, was photographed at last
Wednesday's full meeting of the council by an unnamed prospective
Conservative local election candidate.
But she today denied missing any of the debate and said she only looked through the brochure during breaks in the proceedings.
Coun
Benson said: "I was reading it, but it was either at the beginning of
the meeting or during one of the breaks. I was just flicking through.
"Of course I'm interested in what is happening in my town."

BioPerformance ordered to return more than $7 million to victims of pyramid scheme
AUSTIN - Texas Attorney General Greg Abbott today stopped a
Dallas-based pyramid scheme from illegally marketing the so-called "top
secret gas pill" that it falsely claimed would increase fuel efficiency
in automobiles. The Attorney General's settlement with BioPerformance
and its owners, Lowell Mims and Gustavo Romero, prevents the defendants
from continuing to deceptively market their products and ends the
State's eight-month legal action against the company.

This article claims that BioPerformance can no longer market their product. Based on the BioPerformance press release, the company seems to think they will be marketing the product again soon.
The plot thickens. I'm not sure BioPerformance will recover.

A more than $7 million settlement announced Tuesday blocks a Dallas company from marketing a bogus gasoline additive.
Texas
Attorney General Greg Abbott sued BioPerformance last May over the
drop-in-the-tank pill and powders that experts say falsely were
marketed to increase fuel efficiency.
Investigators determined the sales involved a pyramid scheme.
The lawsuit says BioPerformance made money by getting consumers to purchase the pills in bulk, and then sell them to others.
Abbott's office says consumers who were deceived will share the settlement.
"With
gasoline prices hitting record highs, these defendants aggressively
marketed their worthless product as a wonder-cure,” Abbott said.
“Sadly,
these do-nothing pills were merely the tools of an elaborate pyramid
scheme that enriched the sellers while buyers were left with empty
hands and empty wallets."
The
company’s web site promised fuel savings of 25 percent from the pill
and indicated BioPerformance had a net income of $25 million since
December of 2005.
Scientists
at the University of Texas at Austin and at a Florida university tested
the product, however, and concluded the pills were mainly comprised of
naphthalene, the same chemical found in mothballs, Abbott said after
filing the suit earlier this year.
The Attorney General’s laboratory expert concluded the product could actually decrease engine performance.

BioPerformance Settles with the State of Texas
January
23, 2007, Dallas , TX. BioPerformance, Inc. today entered into an
agreement with the State of Texas which provides several million
dollars for the State of Texas to make restitution for any existing
issues of customer satisfaction and opens the door for the marketing of
BioPerformance Fuel very soon. BioPerformance Fuel is an additive
designed to increase fuel economy and decrease emissions. Recently
completed testing of BioPerformance Fuel by an independent laboratory
using the Federal Test Procedure (FTP) and Highway Fuel Economy Test
(HFET) protocols of the Environmental Protection Agency (EPA) in a
group of vehicles established a reasonable degree of confidence that
the product gives a real improvement in fuel economy and reduction in
harmful emissions. (The laboratory report is attached). News reports
show that the EPA has previously tested more than 100 other fuel
additives under its FTP and HFET protocols, with no demonstrable
positive results. The company believes that BioPerformance Fuel is the
first fuel additive proven effective by an independent laboratory under
the EPA’s strict protocols.
BioPerformance today announced: “We are extremely pleased to be
putting behind us the action by the State of Texas . We also are very
pleased with the test results obtained so far. Distributors may expect
to resume marketing the product soon.
“Several months ago, BioPerformance Fuel was the target of numerous
media reports challenging its effectiveness. We believe these reports
relied on the evidence of under-informed ’experts’ or ineffective or
non-existent testing. To our knowledge, none of the reports were
supported by tests comparable to the Federal Test Procedure and Highway
Fuel Economy Test protocols used by the independent laboratory in its
recent testing of BioPerformance Fuel.”
In its agreement with the State of Texas , BioPerformance
specifically denied any wrong-doing. However, BioPerformance reports:
“It is important to ensure that the product and sales program meet all
lawful requirements so that all of our energy can be devoted to helping
consumers save gas and reduce pollution.”
