GRAND RAPIDS, Mich. (WOOD) - A federal judge has ruled against Amway Corp. in a class-action complaint filed by 27 former salespeople, or independent business owners.
The ruling says Amway must stop forcing its one-time distributors into arbitration over disputes between the two parties.
The independent distributors had filed a complaint against Amway asking the court to stop Quixtar, Amway's e-commerce business, from "harassing and intimidating plaintiffs ... with repetitive arbitrations asserting trumped up violations of Quixtar's unilaterally-enacted ... trade secret rules."
According to the complaint, when potential independent business owners, or IBOs, start up with Quixtar, they sign a registration form that lists the company's rules for engaging in "arbitration" as a means of resolving disputes.
But the court ruled the agreement to arbitrate did not extend to "post-termination disputes involving former IBOs who are no longer operating an Amway 'Independent Business.' "

Liu Mingxiong, vice-president of Amway Greater China, revealed that the company will not open online shops, and does not allow any of its direct salespeople to open such shops.
As e-commerce businesses expand rapidly in China, more companies are choosing the internet as a platform to sell their products. However, Amway China, one of the country's largest direct sales companies, says it has other considerations.
Liu Mingxiong, vice-president of Amway Greater China, revealed that the company will not open online shops on the country's largest auction website, Taobao.com, and does not allow any of its direct salespeople to open such shops, because "the sales mode will cause unfair competition among other staff members who focus on direct sales."
"We oppose the new-style mode not because we do not like it," Liu explained. "Amway has been aiming to provide the staff with an equal-footing opportunity to gain additional earnings or to set up their own careers. Therefore, we will not sacrifice their chance to seek temporary profits."
Liu also warned consumers to be cautious about so-called Amway products sold on the internet with 50 percent discount or more, "they are too cheap to be true."
Last year, the sales revenue of Amway China hit 17.6 billion yuan, an increase of 28 percent compared with the year before. The figure makes up 31 percent of Amway's global sales revenue, making Amway China the company's largest subsidiary.
The business expansion in China is attributed to the country's improved laws and regulations concerning direct and pyramid selling since 2005, Liu said.

Here's a good thing from Amway.
The 50th Anniversary Amway One by One program for India “Project Sunrise” is focused on installing water purifiers at specialized schools, orphanages and institutions across more than 50 cities throughout India where Amway has a strong corporate presence. Additionally, volunteers assist in teaching English language and public speaking skills.
The approach is holistic. While Project Sunrise is providing access to safe drinking water, they are meeting the needs of individual children across the country through very diverse needs of their NGO partners. Funding and volunteerism is supporting annual educational and health sponsorships, Braille textbooks, physiotherapists and providing for basic needs like food, shelter and clothing. Arlington, VA – U.S. high school students and their teachers are invited to compete for nearly $200,000 in prize money by participating in the fourth annual Being an American Essay Contest. Top prize winners and their teachers will also receive all-expenses paid trips to the nation’s capital.

Update: Greg Duncan Bankrupt?
WWDB Triple Diamond, Greg Duncan actually owns one of the most popular product lines in the world of Quixtar, XS Energy Drink, according to an article in Beverage World.
The article lists the co-owners of XS Worldwide as Josh Bradbury, Scott Coon, Greg Duncan, David Vanderveen. Scott Coon was once an Emerald, personally sponsored by Greg and I believe that David Vanderveen is a cousin to Amway/Quixtar owners, the Van Andels.
Here is the first thing that came to my mind: No matter how bad Quixtar's compensation plan is, I'm betting that Greg Duncan will be sticking around. He is probably making a lot of money when all of the other lines of sponsorship promote XS Energy Drink.
Now, speaking of XS Energy Drink and Greg Duncan, I found a bit more interesting news...
It seems that Greg Duncan is expanding his marketplace outside of Quixtar with a brand of energy drinks called, "All In".
Here is a link to an article that calls Greg Duncan, CEO of All In Energy. So now, Greg Duncan, along with former World Wide Dream Builders diamond (current Emerald?), Rod Jao, who is Vice President of All In Energy are out selling a product that competes directly with XS Energy Drink.
"Competes directly with Quixtar" is probably the most important words to consider here if you follow the Quixtar non-compete rules that the company has been making waves over.

Just read this on former Quixtar Executive Diamond and founder of the TEAM, Orrin Woodward's blog:
My letter to Doug Devos clearly explains that over 600,000 people who speak English as a first language signed up into Quixtar in 1999 and 2000. Out of these 600,000 IBO’s (misnomer?) only six achieved Founders Emerald or above by the end of 2004. This is 4 to 5 years and only 1 out of 100,000 achieved $87,000 annual income from the plan with both the husband and wife working exhaustively. Out of those six who achieved Founders Emerald by 2005, five were on the Team – Tim Marks (Founders Diamond), Doug Stroh, Mike Foos, Matt Abraham, Kirk Birtles were all founders emerald or above by the end of 2004. (I believe this is the five.)
If this is not true, Amway's legal team would be all over Woodward, leading me to believe that the statistics are true.
